Terms of Service

These Terms of Service ("Terms") govern your use of the SWS EtsyTool Chrome extension and related services ("Service") operated by Spectro Web Solutions ("we", "us", "our"). By using the Service, you agree to these Terms in full.

1. Service Description

SWS EtsyTool is a Chrome browser extension that helps Etsy sellers automate the process of importing order data from Etsy and submitting it to Dianxiaomi (店小秘) ERP system. The Service includes order CSV import, AI-powered address correction, and order submission to Dianxiaomi.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Service, you represent that you are an authorized Etsy seller and that you have the right to process the order data you submit through the Service.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately if you suspect unauthorized access to your account.

4. Free Trial and Subscription

• New accounts receive a 7-day free trial with access to up to 100 orders.
• After the trial period, you must subscribe to a paid plan to continue sending orders to Dianxiaomi.
• Subscription plans are billed monthly. Prices are listed in Chinese Yuan (CNY) on our website.
• Payment is processed via WeChat Pay. Subscriptions are activated manually upon payment confirmation.
• Subscriptions are valid for 30 days from activation. Monthly order limits reset upon renewal.
• We reserve the right to change pricing with 30 days' advance notice.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Submit fraudulent, false, or misleading order data
• Attempt to gain unauthorized access to our systems, databases, or other users' accounts
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Share your account credentials with third parties
• Use the Service to process data for which you do not have proper authorization
• Interfere with or disrupt the Service or its infrastructure
• Circumvent any usage limits, subscription controls, or security measures

6. Data Processing

By using the Service, you acknowledge that:

• Order data (including recipient names, addresses, and order details) is stored on our secure servers to facilitate order processing
• Address data may be processed by third-party AI services (Google Gemini) for correction purposes
• Order data is submitted to Dianxiaomi on your behalf using your existing Dianxiaomi session
• You are responsible for ensuring you have the right to process and transfer the personal data contained in your orders

7. Intellectual Property

The Service, including its code, design, branding, and documentation, is the property of Spectro Web Solutions and is protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Third-Party Services

The Service interacts with third-party platforms including Etsy, Dianxiaomi, and Google Gemini AI. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of these platforms is subject to their respective terms of service.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We are not liable for any incorrect address corrections made by the AI system
• We are not liable for any errors, failures, or delays in order submission to Dianxiaomi
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim

11. Account Suspension and Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after account termination.

12. Refund Policy

Due to the nature of the digital service, all subscription payments are non-refundable once the subscription has been activated. If you experience technical issues preventing you from using the Service, please contact us and we will work to resolve the issue or provide a pro-rated credit at our discretion.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via the email address associated with your account. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms shall be resolved in the courts of Poland.
